随着国内天然气清洁能源爆发式增长需求,天然气行业在上游地面工程建设中推行多年的总承包建设模式,通过设计、采购、施工各个环节的有效衔接,取得了减少投资、缩短工期、提高经济效益的良好效果,对保障民生和国家能源安全具有积极的意义。天然气地面建设工程是庞大的系统工程,“合同”作为保障这项系统工程良好运转的载体,在建设过程中发挥着重要作用,因而在工程建设取得良好效果的同时,在合同管理过程中集中反映出诸多风险,暴露出在合同管理方式、管理思路方面的诸多问题。基于天然气行业工程总承包项目合同管理积累的经验,针对总承包项目的特点,分析阐述总承包模式下的各种合同风险点,并提出针对合同风险的解控思路,以期对今后的总承包项目合同管理提供参考。
As domestic demand for clean natural gas experienced explosive growth, the natural gas industry adopted multi-year general construction contracts for upstream ground engineering projects. Through the seamless coordination of design, procurement and construction, this type of contracts decreased capital investment, shortened construction duration, and increased productivity.Nevertheless, risks still persisted. Natural gas ground construction projects are huge and complex. Contracts, although essential to the smooth implementation of such projects, are prone to risks such as poor negotiation and implementation. Based on many years of experience with multi-year construction contracts, this paper discusses certain common features, pitfalls and proposes solutions.
